Please read these Terms & Conditions carefully before using the Elgomart platform (including the customer app, partner app, and packer app). By accessing or using Elgomart's services, you agree to be bound by these terms. These terms are governed by the laws of India, including the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.
1. Acceptance of Terms
By downloading, installing, or using any Elgomart application or website, you confirm that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use our services.
These terms form a legally binding agreement between you and Elgomart. We reserve the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms.
2. Eligibility
You must be at least 18 years of age to use Elgomart's services.
By using the platform, you represent and warrant that you are legally competent to enter into a binding contract under the Indian Contract Act, 1872.
Delivery partners must hold a valid driving licence and be legally permitted to operate a motor vehicle in India.
Elgomart reserves the right to refuse or terminate service to any user at its sole discretion.
3. Account Registration
To use Elgomart's services you must create an account by providing accurate, current, and complete information. You are responsible for:
Maintaining the confidentiality of your login credentials (OTP, password).
All activities that occur under your account.
Notifying us immediately at support@elgomart.com if you suspect unauthorised use of your account.
You may not create more than one account, impersonate another person, or provide false information during registration. Elgomart reserves the right to suspend or terminate accounts found to be in violation of these terms.
4. Orders and Delivery
4.1 Placing Orders
Orders placed through the Elgomart customer app are subject to availability. By placing an order, you agree to purchase the selected items at the displayed price, inclusive of applicable taxes and delivery fees.
4.2 Delivery
Delivery is available only within serviceable areas as shown in the app.
Estimated delivery times are indicative and may vary due to factors beyond our control (traffic, weather, partner availability).
You must be available to receive the order at the specified delivery address at the time of delivery.
4.3 Cancellations
You may cancel an order before it is picked up by the delivery partner.
Once an order has been picked up, cancellation may not be possible.
Elgomart reserves the right to cancel any order due to unavailability of items, payment failure, or suspected fraud.
4.4 Refunds
Refunds for cancelled or undelivered orders are processed to the original payment method within 5โ7 business days, subject to bank processing timelines. For disputes, contact support@elgomart.com.
5. Payments
RBI Compliance
All payments on Elgomart are processed through Razorpay, an RBI-licensed Payment Aggregator. By making a payment, you agree to Razorpay's Terms of Service.
Prices displayed are inclusive of all applicable taxes (GST) unless stated otherwise.
Elgomart does not store your card, CVV, or net banking credentials. All payment data is tokenised and handled by Razorpay.
In case of a failed payment, please contact your bank or Razorpay support before attempting again.
Elgomart reserves the right to modify pricing, fees, and charges at any time.
6. Partner (Delivery Agent) Terms
6.1 KYC Requirement
All delivery partners must complete KYC (Know Your Customer) verification before accepting orders or receiving payouts. Required documents include a government-issued photo ID (PAN Card, Voter ID, or Driving Licence), a selfie, and proof of address. KYC details are verified in accordance with RBI KYC Master Direction, 2016.
6.2 Conduct
Partners must handle orders with care and complete deliveries promptly.
Partners must not misrepresent their identity, tamper with orders, or engage in fraudulent activity.
Rude, abusive, or threatening behaviour towards customers or staff is grounds for immediate termination.
6.3 Earnings and Payouts
Earnings are calculated based on completed deliveries and applicable incentive structures as communicated by Elgomart.
Payouts are processed to the bank account or UPI ID registered during onboarding.
Elgomart reserves the right to withhold or adjust payouts in cases of dispute, fraud, or policy violation.
Partners are responsible for any applicable income tax obligations on their earnings.
6.4 Independent Contractor
Delivery partners using the Elgomart platform are independent contractors, not employees or agents of Elgomart. This agreement does not create any employer-employee relationship, partnership, or joint venture between Elgomart and the partner.
7. Packer Staff Terms
Packer staff must complete KYC verification and comply with all operational guidelines as communicated by Elgomart. Packers are responsible for accurate and timely packing of orders. Fraudulent activity, negligence, or misconduct will result in immediate account suspension and may result in legal action.
8. Prohibited Conduct
You must not:
Use the platform for any unlawful purpose or in violation of applicable Indian law.
Attempt to gain unauthorised access to any part of the platform or its systems.
Upload, post, or transmit any harmful, offensive, defamatory, or unlawful content.
Reverse engineer, decompile, or disassemble any part of the Elgomart application.
Use automated tools (bots, scrapers) to access or interact with the platform.
Engage in any activity that disrupts or impairs the functionality of the platform.
Create fake accounts, place fraudulent orders, or manipulate ratings and reviews.
Violations may result in account suspension, termination, and/or legal proceedings under applicable Indian law including the Information Technology Act, 2000.
9. Intellectual Property
All content on the Elgomart platform โ including text, graphics, logos, icons, images, software, and user interface design โ is the exclusive property of Elgomart and is protected under Indian copyright, trademark, and intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any Elgomart content without prior written permission.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
Elgomart is not liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform.
Elgomart's total liability to you for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
Elgomart is not responsible for delays, cancellations, or service disruptions caused by factors beyond its reasonable control (force majeure events).
11. Disclaimer of Warranties
The Elgomart platform is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Data Protection & DPDP Act 2023
DPDP Act 2023 Compliance
Elgomart complies with the Digital Personal Data Protection Act, 2023 (DPDP Act). As a Data Fiduciary, Elgomart:
Collects only the personal data necessary for the purpose of providing our services.
Obtains your explicit consent before processing sensitive personal data.
Maintains the security and accuracy of your personal data.
Notifies you and the Data Protection Board of India in the event of a personal data breach.
Allows you to withdraw consent and request data deletion at any time.

13. Governing Law and Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall first be attempted to be resolved through good-faith negotiation.
If the dispute is not resolved within 30 days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, and the seat of arbitration shall be India. The award of the arbitrator shall be final and binding.
Nothing in this clause prevents either party from seeking urgent injunctive relief from a competent court.
14. Consumer Protection
In accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, Elgomart:
Displays complete pricing information, including taxes and delivery charges, before checkout.
Provides a clear returns and refunds process.
Does not engage in unfair trade practices, misleading advertisements, or manipulative pricing.
Maintains a Nodal Officer / Grievance Officer to address consumer complaints within the timelines prescribed by law.
15. Grievance Officer
In accordance with the IT (Intermediary Guidelines) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, we have designated a Grievance Officer:
Elgomart reserves the right to modify these Terms & Conditions at any time. When we make material changes, we will notify registered users via the app or email at least 7 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised terms.
